This Privacy Policy describes the policies and procedures of Lightning Loader ("the Service", "the Platform") on the collection, use, disclosure and protection of Your information when You use the Service. It also sets out the legal terms governing Your use of the Platform, including limitations of liability and indemnity provisions.

By accessing or using the Service, You agree to the collection and use of information in accordance with this Privacy Policy and accept the legal terms set out below.

1. Interpretation and Definitions

1.1 Interpretation

Words with an initial capital letter have the meanings defined below. These definitions apply whether the terms appear in singular or plural.

1.2 Definitions

  • Account — a unique account created for You to access the Service or parts of the Service.
  • Company (also referred to as "We", "Us" or "Our") — refers to Lightning Loader.
  • Cookies — small files placed on Your device by a website, containing browsing history and session details.
  • Device — any device that can access the Service, such as a computer, mobile phone or tablet.
  • Personal Data — any information that relates to an identified or identifiable individual.
  • Service — refers to the Lightning Loader website and all associated tools, APIs and features.
  • Service Provider — any third-party company or individual employed by the Company to facilitate, provide or analyse the Service.
  • Usage Data — data collected automatically, including page visits, session duration, IP address, browser type and device identifiers.
  • Load Plan Data — cargo dimensions, weights, container configurations, packing results and any associated metadata that You create using the Service.
  • You — the individual accessing or using the Service, or the company or legal entity on whose behalf such individual is acting.

2. Data We Collect

2.1 Personal Data

When You register for an Account or use the Service, We may collect:

  • Email address
  • First name and company name
  • Password (stored using industry-standard cryptographic hashing — We cannot read Your password)

2.2 Usage Data

Usage Data is collected automatically and may include Your Device's IP address, browser type and version, pages visited, time and date of visit, time spent on pages, unique device identifiers and diagnostic data.

2.3 Load Plan Data

When You use the Load Planner, We process and may store:

  • Cargo item details (dimensions, weights, descriptions, quantities)
  • Container/truck selection and configuration
  • Packing results, including packed item positions
  • Saved plan names and metadata

Load Plan Data is stored to enable You to save, retrieve and share Your load plans. We do not sell or share Your Load Plan Data with third parties.

2.4 Cookies and Tracking Technologies

We use Cookies and similar technologies to:

  • Maintain Your authentication session
  • Remember Your preferences (e.g. metric/imperial units, shipper details)
  • Analyse usage patterns to improve the Service
  • Deliver advertisements to support the free Service

You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, some parts of the Service may not function properly without Cookies.

3. How We Use Your Data

We may use Your data for the following purposes:

  • To provide and maintain the Service — including load calculations, 3D visualisation, PDF export and plan storage.
  • To manage Your Account — registration, authentication and single-session enforcement.
  • To contact You — service updates, security notifications and support responses.
  • To improve the Service — analysing usage patterns, identifying performance issues and developing new features.
  • To enforce our terms — detecting abuse, preventing unauthorised access and enforcing single-session policies.
  • To comply with legal obligations — responding to lawful requests from public authorities.

4. Data Sharing and Disclosure

4.1 Service Providers

We may share Your data with third-party Service Providers who assist in operating the Service (e.g. hosting, payment processing, analytics). These providers are contractually obligated to protect Your data and use it only as directed by Us.

4.2 Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before such transfer.

4.3 Law Enforcement

We may disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court order or government agency).

4.4 No Sale of Personal Data

We do not sell Your Personal Data to third parties.

4.5 Advertising Partners

The Service is supported by advertisements. Third-party advertising networks may use Cookies and similar technologies to serve ads based on Your browsing activity. These partners operate under their own privacy policies. You can opt out of personalised advertising through Your browser settings or the advertising network's opt-out tools.

5. Data Retention

We retain Your Personal Data only for as long as necessary for the purposes set out in this Policy:

  • Account data — retained until You delete Your account.
  • Load Plan Data — retained until You delete individual plans or Your account.
  • Usage Data — retained for up to 24 months for analytics purposes.

When You delete Your account, all associated Personal Data and Load Plan Data are permanently removed from our systems within 30 days.

6. Data Security

We implement commercially reasonable security measures to protect Your data, including:

  • Passwords are hashed using industry-standard algorithms (ASP.NET Identity)
  • Authentication cookies are validated against security stamps — logging in from a new device invalidates all previous sessions
  • HTTPS encryption for all data in transit
  • Saved plans are isolated per user — only the account owner and administrators can access them

However, no method of electronic transmission or storage is 100% secure. While We strive to protect Your data, We cannot guarantee absolute security.

7. Your Rights

Depending on Your jurisdiction, You may have the following rights regarding Your Personal Data:

  • Access — request a copy of Your Personal Data.
  • Rectification — request correction of inaccurate data.
  • Erasure — request deletion of Your data (available via the "Delete Account" button in Account Settings).
  • Data Portability — request Your data in a machine-readable format.
  • Objection — object to processing of Your data for certain purposes.
  • Withdrawal of Consent — withdraw consent at any time where processing is based on consent.

8. Children's Privacy

The Service is not directed at anyone under the age of 16. We do not knowingly collect Personal Data from anyone under 16. If You are a parent or guardian and become aware that Your child has provided Us with Personal Data, please contact Us. If We discover that We have collected Personal Data from anyone under 16 without parental consent, We will take steps to remove that information promptly.

9. Third-Party Links

The Service may contain links to third-party websites. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites. We strongly advise You to review the privacy policy of every site You visit.

These terms form part of Your agreement to use the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY.

Without limiting the foregoing, We make no warranty or representation that:

  • The load plans, packing calculations, centre-of-gravity computations, axle weight estimates, lashing calculations or any other output generated by the Service are accurate, complete, reliable or suitable for any particular application.
  • The Service will meet Your requirements or expectations.
  • The Service will be uninterrupted, timely, secure or error-free.
  • Any errors or defects in the Service will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS OR AFFILIATES BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, goodwill, business opportunity or anticipated savings;
  • Damages arising from cargo loss, cargo damage, transport accidents, vehicle overloading, structural failure, incorrect lashing, non-compliance with regulations, or any physical harm to persons or property;
  • Damages arising from reliance on any load plan, packing result, weight calculation, axle weight estimate, centre-of-gravity computation, lashing calculation, securing plan or any other output produced by the Service;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, Our liability shall be limited to the maximum extent permitted by law. In any event, Our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the amount You have paid to Us in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend and hold harmless the Company, its officers, directors, employees, agents, licensors and suppliers from and against any and all claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of or reliance on the Service or any output produced by the Service, including load plans, packing calculations, weight estimates, lashing calculations and PDF exports;
  • Any decision You make based on information provided by the Service, including but not limited to loading decisions, transport decisions, lashing configurations and compliance determinations;
  • Your violation of these terms or any applicable law, regulation or industry standard;
  • Any claim by a third party arising from Your use of the Service, including claims related to cargo damage, personal injury, property damage or regulatory non-compliance;
  • Your failure to independently verify the accuracy and suitability of any output from the Service before acting upon it.

13. Professional Responsibility & User Obligations

You acknowledge and agree that:

  • The Service is a planning and estimation tool only. All calculations, including packing layouts, centre-of-gravity calculations, axle weight estimates, lashing requirements and securing plans, are approximations and must not be relied upon as the sole basis for any operational, safety or compliance decision.
  • You are solely responsible for verifying that all load plans comply with applicable laws, regulations, industry standards and best practices, including but not limited to:
    • IMO/ILO/UNECE Code of Practice for Packing of Cargo Transport Units (CTU Code)
    • EN 12195 series (Load restraining — Safety)
    • Local and national road vehicle weight limits and axle weight regulations
    • IATA Dangerous Goods Regulations and ULD handling standards
    • Any other applicable transport safety legislation
  • Axle weight calculations displayed by the Service are estimates based on simplified beam models and estimated tare weights. They do not replace manufacturer specifications, certified weighbridge measurements or professional engineering assessments.
  • Lashing calculations are based on generalised parameters and do not constitute a certified securing arrangement. All cargo securing must be verified by a qualified person in accordance with applicable standards.
  • You must employ qualified personnel to supervise and approve all loading, securing and transport operations.
  • The Company shall not be held liable for any consequences arising from Your failure to independently verify and validate any output from the Service.

14. Governing Law & Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company operates, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue resolution through the courts of competent jurisdiction.

15. Severability

If any provision of these terms is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.

16. Changes to This Policy

We may update this Privacy Policy and Legal Terms from time to time. We will notify You of any material changes by posting the updated document on this page and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.
